The European Commission has launched a Public consultation on the Energy and Environmental State Aid Guidelines (EEAG). The aim of the consultation is to allow interested parties to provide their feedback regarding the design of the future Guidelines on State aid for environmental protection and energy (EEAG) that will apply from 1 January 2022 and the related articles 36 to 49 in the General Block Exemption Regulation (GBER).

The revision of the EEAG and the related provisions of the GBER occurs against the backdrop of recent regulatory changes in the field of energy policy and environmental protection, as well as the Commission?s intention to make Europe fit for the digital age, the Industrial Strategy and the European Green Deal which aim to transform the EU into a carbon neutral economy by 2050, as well as into a circular economy thriving for zero-pollution, where natural capital is protected.

This consultation also follows the results of the ?fitness check?. Although the EEAG and related provisions in GBER generally delivered on their objectives, the fitness check showed that they are not entirely suited to face the climate neutrality challenge, both in terms of scope and in terms of the compatibility conditions to ensure necessity of aid, proportionality and limitation of distortions. The first part of the consultation focusses on options to define those compatibility conditions. Second, the fitness check showed that it is unclear whether compatibility provisions on support in the form of reductions on charges for the financing of renewable policies granted to Energy Intensive Users has led to the introduction of more ambitious renewables policies by all Member States. The last part of the consultation focuses on collecting stakeholders? views on compatibility conditions for those reductions.
